We’re an online platform maintained by Setle, Inc. (“we,” “our,” “us”) which lets users securely transfer and sell digital files to anyone, anywhere. Here we describe how we collect, use, and handle your personal information when you use our websites, software, and services (collectively, “Setle” or the “Services”).
Your privacy is important to us. When running Setle, we follow a few fundamental principles:
- We don’t ask you for information that by itself can be used to identify you (for example, your name, email address, postal address, or phone number) (collectively, “Personal Information”) unless we truly need it. That being said, what we do ask for is used to enable us to securely transfer and sell digital files. We talk more about what information we require below.
- We’re not a huge, faceless corporation. We’re just normal people trying to make something great.
- We don’t share your Personal Information with third parties except to comply with the law, make Setle better, protect our rights, or in the event of a business transfer.
- We don’t store Personal Information on our servers unless required for the on-going operations.

How You Accept This Policy
What Information Do We Collect?
We collect and use the following information to provide, improve, and protect our Services:
Account information. We collect, and associate with your account, the information you provide to us when you do things such as sign up for your account, and set up two-factor authentication (like your name, email address, phone number, payment info, billing address, and shipping address). Some of our Services let you access your accounts and your information via other service providers.
Payment information. We, or companies that provide services on our behalf, may also collect certain financial information from you, such as your payment method (this may include valid credit card number, type, expiration date, or other financial information). By making a purchase through Setle, you give us consent to use and provide your financial information as we consider necessary to process the transaction.
Your Stuff. Our Services are designed to make it simple for you to upload share, edit and distribute your content, (“Your Stuff”), collaborate with others, and receive payment across multiple devices. To make that possible, we store, process, and transmit Your Stuff as well as information related to it. This related information includes your profile information that makes it easier to collaborate and share Your Stuff with others, as well as things like the size of the file, the time it was uploaded, collaborators, and usage activity. Our Services provide you with different options for sharing Your Stuff.
Usage information. We collect information related to how you use the Services, including actions you take in your account (like sharing, editing, viewing, and moving files or folders) and specific message information shared on the platform, such as: the date of your messages, how the messages were shared, and the number of messages you sent. We use this information to improve our Services, develop new services and features, and protect Setle users.
Device information. We also collect information from and about the devices you use to access the Services and various analytics data. This includes things like (i) the IP addresses of the computer or mobile device you use to access our Site, (ii) the type of browser software and device you use, (iii) the operating system you are using, (iv) the date and time you access or use our Site, (v) the web page you visited before coming to our sites, (vi) the website address, if any, you travel to after leaving our website, (vii) other non-personally identifiable traffic data and (viii) identifiers associated with your devices. Your devices (depending on their settings) may also transmit location information to the Services. We will anonymize this information as necessary as part of our dedication to your privacy security.
Cookies and other technologies. We use technologies like cookies and pixel tags to provide, improve, protect, and promote our Services. For example, cookies help us with things like remembering your username for your next visit, understanding how you are interacting with our Services, and improving them based on that information. You can set your browser to not accept cookies, but this may limit your ability to use the Services.
In order to improve and grow Setle, we also use analytics tools, such as Google Analytics, to automatically collect information about user and visitor usage (collectively, “Analytics Tools”). These Analytics Tools collect data such as how often you visit Setle, what areas of the Site you visit, and what other sites or services you used prior to using Setle.
Analytics Tools generally operate differently. For example, Google Analytics only collects the IP address assigned to you on the date you visit Setle, not your name or other identifying information. Although Google Analytics plants a permanent cookie on your computer to identify you as a unique user the next time you visit, the cookie cannot be used by anyone but Google. As of right now, we only use the information we get from Analytics Tools to improve our Site and do not combine the information collected through the use of Analytics Tools with Personal Information. However, we reserve the right to do so in the future.
Bases for processing your data. We collect and use the personal data described above in order to provide you with the Services in a reliable and secure manner. We also collect and use personal data for our legitimate business needs. To the extent we process your personal data for other purposes, we ask for your consent in advance or require that our partners obtain such consent.
Communications you initiate with us. We do everything possible to make sure you have an amazing experience on our Site. If you contact us in person, by phone, email, or by some other means (either through our Site or through a Third Party Service), we may keep a record of your contact information and correspondence for later reference (to help improve our Site and service to you).
How We Use the Information We Gather
We primarily use the information we collect and store to enhance Setle. Except if we sell all or a portion of our business, or as otherwise described below, we do not rent, trade, or sell your Personal Information.
Use to provide our site to you. We use Personal Information to create an awesome experience. Some ways we may internally use your information include to:
- Provide, maintain, administer, or expand Setle and deliver to you information that you request;
- Respond to correspondence that we may receive from you;
- Perform business analyses or support, improve, or enhance Setle or other products and services we offer;
- Send you Setle-related information (through email or otherwise) such as updates, special offers, and changes to certain legal documents, or content that we think will interest you based on your preferences;
- Contact you when necessary or requested;
- Customize and tailor your Setle experience; or
- Prevent, detect, and investigate security breaches or potentially illegal or prohibited activities.
Aggregated personal data and non-personal information. We may share or disclose aggregated Personal Data or Non-Personal Information with service providers, or with other persons we conduct business with. These service providers and other persons may also share with us aggregated Non-Personal Information that they have independently developed or acquired. Additionally, we may combine aggregate information from the pixel tags, web beacons, and cookies with similar data we collect from other visitors to help us improve our Site. When doing so, we do our best to ensure that any aggregated information cannot be linked back to you.
Agents or third-party partners. We may provide your Personal Information to our employees, contractors, agents, service providers, and designees (“Agents”) to enable them to perform certain services for us exclusively, including:
- Payment processing;
- Website-related services such as web hosting;
- Improvement of website-related services and features;
- Maintenance services; or
- Development of new services.
We may share information as discussed below, but we won’t sell it to advertisers or other third parties.
Other users. Our Services display information like your name, profile picture, and email address to other users in places like your user profile and sharing notifications. Certain features let you make additional information available to others. For example, when creating content for a buyer or collaborating on a project, Your Stuff will be visible to the other party after your submission.
Law & Order and the Public Interest. We may disclose your information to third parties if we determine that such disclosure is reasonably necessary to: (a) comply with any applicable law, regulation, legal process, or appropriate government request; (b) protect any person from death or serious bodily injury; (c) prevent fraud or abuse of Setle or our users; (d) protect Setle’s rights, property, safety, or interest; or (e) perform a task carried out in the public interest.
Protection of Personal Information
Security. The security of the information you provide is extremely important to us. We employ several physical and electronic safeguards to keep your information safe, including encrypted user passwords and securing all connections with industry standard transport layer security. We have a team dedicated to keeping your information secure and testing for vulnerabilities. We also continue to work on features to keep your information safe in addition to things like two-factor authentication, encryption of files at rest, and alerts when new devices and apps are linked to your account. We deploy automated technologies to detect abusive behavior and content that may harm our Services, you, or other users.
If you log into your account on a shared computer, be sure to sign out of your account when finished. If you believe a third party has access to your account, you must let us know as soon as possible.
Even with all these precautions, we cannot fully guarantee against the access, disclosure, alteration, or deletion of data through events such as, but not limited to, hardware or software failure or unauthorized entry or use.
User Controls. You can access, amend, download, and delete your personal information by logging into your Setle account and going to your account settings page. You can also limit the way we collect and use your data on the user control page of your Setle account. Click here to learn how to change your profile information.
Retention. Setle will retain your data for the life of our services. If you delete your account, we may retain some Personal Information that you have provided to us in order to maintain the Site for other members or to comply with relevant laws.
Online Tracking and How We Respond to Do Not Track Signals
Online tracking is the collection of data about an individual’s Internet activity used to deliver targeted advertisements and for other purposes. Some web browsers (including Safari, Internet Explorer, Firefox, and Chrome) incorporate a “Do Not Track” (DNT) or similar feature that signals to websites that a visitor does not want to have his/her online activity and behavior tracked. If an online service elects to respond to a particular DNT signal, the service may refrain from collecting certain Personal Information about the browser’s user. Not all browsers offer a DNT option and there is currently no industry consensus as to what constitutes a DNT signal. If you do not agree to this Agreement or any modification to this Agreement, you should not use our Site.
We are especially sensitive about children’s information. We’re not a site targeted towards children and we don’t knowingly collect information from children under the age of 13. If you have questions concerning our information practices with respect to children, or if you learn that a child under the age of 13 has used Setle, created a member account, or provided us with Personal Information, please email us at firstname.lastname@example.org.
Your Right to Control and Access Your Information
You have control over your personal information and how it is collected, used, and shared.
For example, you have a right to:
- Erase or delete all or some of Your Stuff in your Setle account.
- Change or correct personal data. You can manage your account and the content contained in it, as well as edit some of your personal data, through your account settings page.
- Access and take your data. You can also ask us for a copy of personal data you provided to us. Please contact us at email@example.com to request access to or to take down your data.
Your Rights as a California Resident
If you are a California resident, you also have the ability to ask us for a notice identifying the categories of Personal Information we share with our affiliates and/or third parties for marketing purposes and the contact information for such affiliates and/or third parties (under California Civil Code Sections 1798.83–1798.84).
